Uzbekistan: Nazim Djumayev – the executioner №1

In December 2014 Nazim Djumayev was arrested – he is notorious as the “Executioner№1”. His whereabouts are kept in strict secret.  

The Association for Human Rights in Central Asia presents the information about a very dangerous criminal. He commits grave criminal acts under the protection offered by high ranking officials of the law enforcement agencies of Uzbekistan. All information about this individual is classified and is absent from publicly available sources.

The information about Nazim Djumayev presented in this report is based on encounters of victims of human rights abuses:
- former prisoners;
- family members of the victims;
- businessmen from whom he extorted money and whose property he appropriated.

Name: Nazim Djumayev (among the criminals he is known as Nazim Bukharskiy (in translation of Bukhara), prisoners know him as the executioner №1)

Age: about 50 years old.

Appearance: tall, according to eye witnesses he is about 180 centimetres, of athletic body type. His gaze is puckish, usually behaves rudely. He is capable of murdering a person for any reason.

Place of birth: He grew up in Bukhara. According to one source he was born in Chardzhou (Turkmenistan), according to another in Bukhara (Uzbekistan).

Marital status: married, has children.

Convictions: He was convicted three time of grave offences — murder, extortion, assault related to robbery. He served time in different prison colonies (approximately between 1994 and 2002).

Cooperation with the secret services: starting from the time of his first term of imprisonment (1990s) Nazim Djumayev cooperated with the administration of the prison colony. Among the prisoners he is known as "lohmach" (a person actively cooperating with the administration of corrective labour institution) and the executioner №1. His cruelty and unscrupulousness attracted special attention of the SNB [National Security Services] operatives. His victims are entrepreneurs whose capital attracts the attention of high-ranking officials or daughters of Islam Karimov. He and members of his criminal group force many entrepreneurs to give up their property for the benefit of third parties under the threat of reprisals against relatives or sexual abuse. In Uzbekistan, the investigation of this type of crime is almost non-existent, in many cases the victim are found guilty.

Djumayev also deals with imprisoned entrepreneurs on the instructions of their competitors. In addition, he commits crimes against prisoners convicted for their religious beliefs, and opponents of the Karimov regime.

Close ties with the Karimov government allow him to open the door of almost any prison cell of any colony of the Main Directorate of Corrections. Djumayev frequently visits Prison No.64/21 in Bekabad, he has unhindered access to the "Jaslyq" prison. He also has access to the Tashkent Prison. For him, just to kill a man, or inflicting grievous bodily harm or committing sexual violence against an individual is simple. There is evidence that Djumayev bangs his victim’s head against the walls of the cell until he loses consciousness, and then kicks in the kidneys and liver, causing unrecoverable damage to the health of the victim.

For a long time, the brothers Hayot and Djavdat Sharifhodjaevs were his protectors.

Informative note:
  • Hayot SHARIFHODJAEV still holds the position of Deputy Chairman of the National Security Service (SNB) in the rank of General.
  • Djavdat SHARIFHODJAEV, former head of the Office for Combating Corruption and Organised Crime, Colonel of SNB. He is accused of illegal business activities, corruption and embezzlement of public funds. At the end of 2014, at a closed hearing of the Military Court of Uzbekistan, Djavdat Sharifhodjaev was sentenced to 4 years of imprisonment. He is serving his sentence in a penal institution of strict regime for former employees of security structures No.64/21, in Bekabad district of the Tashkent region.
For some time, the executioner Nazim Djumayev was under the protection of the eldest daughter of the dictator Islam Karimov, Gulnara Karimova, through the head of the company "Zeromax", Miradil S. Djalalov. Nazim Djumayev and Miradil S. Djalalov are old friends; they served their sentences in the same cell.

Nazim Djumayev has not recently travelled beyond Central Asia and the CIS under his own name. Not so long ago he was in Urumqi (China) on the business of the company called "Abu Sahiy", headed by Timur Tillaev, husband of the youngest daughter of Islam Karimov, Lola Karimova. He often visited the Russian oligarchs of Bukhara origin in Russia and Kazakhstan.

Only publicity and public control can stop crimes committed by Nazim Djumayev and those who protect him.

Documentary entitled “Vatangado” (Rejected by the Motherland)

We present the translation of the documentary entitled “Rejected by the Motherland” broadcasted via “Uzbekistan” TV channel two years ago. This film shows the attitude of the Karimov regime to political refugees. Following the deportation order against a group of the Uzbek citizens from Norway in 2014, this film became very relevant. The film helps to understand why Uzbek authorities use lies against those who seek international humanitarian protection and why they are portrayed as “traitors of the Motherland”; why those who communicate with the “traitors” are imprisoned and the family members of are forced to give evidence against their loved ones who criticise the regime.

When talking about present day of Uzbekistan, development of a secular state, largest economic projects by new production capacity and incomparable creativeness present themselves before one’s eyes. Such large-scale cooperation merits unparalleled political significance, since any company or financial institution, if included in any project, first brings thoughts about its perspectives in the future and the firm belief in the future. This is a recognition that we are on the right path. In fact, when the whole world and even the most developed countries are swallowed by the economic crisis and the worsening of their financial and economic situation, the growth rate of the economy of Uzbekistan, for several years now, is as high as 8% and it is the highest growth rate in the world. If you look carefully, in recent years, our government has been hosting large scale international forums in the fields of economics, finance, education, medicine, and other fields. This demonstrates, once again, that we have carried out extensive work in these areas and they are recognised by the world community.

However, it is wrong to think that all these huge changes and developments taking place in our country, bring pleasure and delight to everyone’s eyes.

There are some evil-eyed people who hate our successes and are ready at any moment to destroy our calm and peaceful life. Unfortunately, there are such dark forces, people with villainous intentions, a group of people hiding behind the faith groups, political purposes, which ignore all creative activities taking place in Uzbekistan.

At the same time, without any specific strategic plans, or certainty of beliefs and goals, based on their own understanding and scattered, individual reflection, they ultimately try to put forward ideas that lead to the decline and degradation, which in essence is a terror. To this end, if necessary, they do not shy away from spilling blood, organising terror, poisoning brain washing, going against the people, against their parents; dissemination of all sorts of wrong and untrue statement become the main instrument in the exercise of their vulgar ideas and plans.

Those day labourers and hired-labourers escape their homeland in order to betray it and wander in foreign countries, soaking up the side of those countries and forces that have ulterior motives in our regions, turn into their instrument, pour water in their mills. Inspired by these forces, they actively lead group which operate in interests of these wanderers, trying to combine the traitours goals, they put forward the idea of quarrelsome and sow discord. These groups consist of criminals, disguised under the guise of political and religious ideas, they set themselves the ultimate goal - the conquest of power by the analysis of the socio-political situation of the country and implementation of hostile ideas which create an unhealthy environment with the help of people who have committed crimes and flee abroad.

What type of people claim leadership and who joined this movement? When we introduce clarity on this issue, then we will have a clear idea about the real purpose of these crowds and flocks.

Take, for example, Muhammdsolikh Matyakubovich Adutov. He was born on 27 May 1969 in the Turtkul District of the Republic of Karakalpakistan. Between 1990 and1995 he came under influence of “Jihad” teachings. In 1996, he was sentenced to 7 years of imprisonment on several criminal charges. Following his release, he initially moved to Kazakhstan, then to the Russian Federation, and finally to Europe, where, in Sweden he claimed and was granted asylum.

Who is Muhammadsolikh Abutov? Why was he sentenced and why does he live abroad, what does he do there? Who is in realty this character? This can be elicited from his personality, the crimes he carried out, moral of his behaviour and other indicators, because while abroad, he manages those who consider themselves opponents.

Jumaboy Matyakubov (Chief Imam-Khatib of the Beruniy District): «He did not study well, tried to enrol in higher education, but could not. He was rejected first by the Msocow, then the Leningrad and later the Tashkent Universities. Unlucky Muhammadsolikh in 1990-91 was educated in little chambers of illegal madrassas. In the process of this training, his mind was poisoned by corrupt political ideas. In general, he turns into a completely different person, with changing beliefs, behaviour and ideology».

Saidkamol Abutov, (prisoner, Muhammadsalikh Abutov’s brother): «When I arrived, my father's words were not really true, what we have been taught, was also not correct. In fact, religion is different thing, we have to live by Islamic law, his thoughts and views changed. When I left, he was not this kind of person, he was a normal person. At the time, there was his temper, easily excitability, some peculiar requirements, simply, he had different views.

Muhammadsolikh returned home with such changes; he began to spread and infiltrate the idea he learned from his mentors among relatives, peers, even to the chief imam khatib of the area mosque. Muhammadsolikh armed himself with inhuman ideas that to achieve one’s goals, as well as any other dogma, one can resort to any immorality and promiscuity, and in this way one can be justified to betray his parents and relatives.

Jumaboy Matyakubov (Chief Imam-Khatib of the Beruniy District): “Salikh had an uncle, who approached me saying, «Master, please, give instruction to my nephew, because of his behaviour we can no longer live among the people. We went to see him; he sat alone in the mosque, which was built by Alamlihuzha. After greetings his brother said - Hey brother, why cannot you walk straight and honest path that our fathers and grandfathers followed. Because of your behaviour we are ashamed to walk with your head held upright. He suddenly said in a rude tone, - I did not call you here, and do not need your advice, do not teach me wits, get up and walk away from here.

Then I replied to him, - Hey, brother I do not think this is the right response, why are you so rude? Do you thing the way you are behaving is right? Both of your parents are elderly and your father is sick. Should you not get a job, earn your living and help your parents and children as a pious Muslim. Should you not be ashamed of sitting here and waiting for someone to bring you a couple of pieces of bread and go hungry if no one brings them? Then, the man replied to me that he does not have such parents. I asked why he claims not to have parents, did they not bring him to this world? He replied, - they brought me to this world but I do not consider them to be my parents because they are not Muslims, they are mushrik, they are infidels”.

When I walked away, he came up to me and asked:
              - Is a mosque house of Allah?
              - Of course, all mosques are houses of Allah.
              - the house of Allah should remain open during all the 24 hours
              - Of course, equally to everyone.
              - Then we request that it stays open during all of the 24 hours.
              - You have to provide for us to access as and when we would like to come.
              - Ok, we shall grant such access and conditions. What will you get up to when you are here?
              - This is none of your business. We are not accountable to you in our conduct.
              - Then I have to reject your request.

Then he said that on the Judgement Day he will have a claim against me in front of Allah because I forced him out from the house of Allah, and he left. 

They were angry with me. They found a room in a house and began to meet regularly. I infiltrated my man for observation and asked him what they were getting up to all night? He told me that they were practicing martial arts, sambo, fighting, karate, then fall asleep and did not even get up for the morning prayer.

As he wrote in his memoirs, he wanted to frighten or to avenge the Imam Khatib, who was very much afraid of changes, who does not want to follow in his path and offers resistance to his ideas.

Jumaboy Matyakubov: “In 1996 the month of Ramadan, I went gathering for iftar [evening meal during the Muslim fast], I lead a Tarawih [extra prayers performed by Sunni Muslims at night in the Islamic month of Ramadan] and after Tarawih returned home late and my wife said that I had a lot of calls. 20-30 times asking where I was when shall I return. They wanted to know the time of return home. After returning home, I went to bed to rest until saharlik (a meal before dawn, during the Muslim fasting) and heard a loud rumble, ran out to the courtyard and saw that the gates of the house were burning. What they did was to take a bundle of cotton, poured gasoline over it and set fire to the upper part of the gate. Inside, there was a car of "Volga -21" model. Gasoline reached the car. Neighbors came out quickly and helped put out the fire.

In 1996, by the decision of the court Muhammad Abutov was sentenced to 7 years of imprisonmen for these actions. Did his criminal acts, or the machinations end there and during the period of his sentence he became a better person reaching right conclusions? There is a saying «if a good person turns bad - believe it and do not believe, if bad person turns good.” For, our "hero" yet again proved it to be true”.

Saidkamol Abutov (prisoner, a brother of Muhammadsalikh Abutov): In 2004, after his release he worked on the road-surface-coating plant, and after 3 months left for Kazakhstan to work. He used to bring disks from Kazakhstan containing Abduvali Domla’s lectures/preaching and multiply them. The same way, he went there, to bring books and printed them with the guys using a computer and disseminated this literate. In addition, during the period of his detention in 2000, he creates an illegal religious group entitled "Ahly Tavbad" and supervised its activities.

One of the pupils of this group Oltiboy Khakberdiyev (title) his name is Saxtus (prisoner) later, following the Muhammadsolikh’s instructions crosses the border to Afghanistan illegally and gets training in guerrilla camps. On his return, he gets arrested by the authorities when attempting to blow-up a German military base located in the Termez city of the Surkhandarya region. After the authorities uncovered this misdeed by Muhammadsolikh Abutov, he left initially for Kazakstan and then to Russia. We shall come back to where he went next, but, for now, let us draw your attention to the family situation of Abutov. If you paid attention, one could notice that from early childhood Muhmmadsolikh Abutov had an unlucky life. He could not find his place in the society, neither by this study nor by this work or by any other medium for that matter. The same can be said about his position in his family.

Saidkamol Abutov (prisoner, a brother of Muhammadsalikh Abutov): While still at the school, he (Muhammadsalikh Abutov) married a girl named Mukhayo, he kidnapped her at the age of 16 or 17. They lived together for no more than 2-3 months. When he put her under pressure demanding that she lived according to Sharia, she escaped. He demanded respect not only from his wife but from her brothers too. He often argued and demanded the Sharia law to be followed.

Saidkamol Abutov, continues: I often had arguments with my younger brother on the subject that my wife was not wearing a head-scarf. In one of such arguments he threatened that there will be bloodshed. I replied so be it. In one of the arguments, he took a heavy mixing tool from the kitchen and hit me on my head 4 times. I do not remember what happened next. When I recovered I left escaped the home. I told my father that I cannot live with him under the same roof anymore. I asked for his blessing and explained that I cannot live in arguments continuously”.

Long story short, Abutov poisoned not only his own life but the lives of his brothers, parent and extended family, and brought a great disrespect for the family.

Jumaboy Matyakubov (Chief Imam-Khatib of the Beruniy District): There was no good of them for the people. If any good or benefit came from them the people would know. He worked exclusively on propaganda of his way and propagation of his ideas and ideas of his stream, again on possible organisation of these matters. After a conversation with him his father told me, dear teacher, there is no way to remedy, I am really sorry, if we cannot correct him, I am no longer able to control him, I have no strength.

Thus ends Muhamadsalikh Abutov’s activity in Uzbekistan full of crimes and bad luck, and his life as a refugee abroad begins.

However, his analysis of a peaceful and quiet lives of civilians homeland did not end. Now he took to muddy the waters from afar. Now he took to muddy the waters and founded the group "Tayanch Zhamiyati" (Society for Support) and wants to put unite all the refugees. To increase the number of members of this group he addresses the public and terrorist groups located in Afghanistan and Pakistan through the Internet, asking them to cooperate.

“Dear compatriots and people sharing the same faith. I have a desire to address you with an official appeal. Brothers, you do not worry on Afghan soil and you saw what changes on the brought the Arab Spring. Don’t you think it is time to unite all our efforts in this direction?”

In response, the terrorist groups refused their appeal and see their society as wrong, blasphemous and dancing to the music of the West.

This appeal shows how democratic is the Tayanch society. In fact, it is not difficult to understand that by collaborating with a terrorist group what kind of "just" the organisation they want to create.

Muhamadsolikh Abutov appealed via the Internet to citizens of Uzbekistan. He tries to involve young people in his group using different lies. Some of those who believed in these lies, got caught on lies. One of such youth is a 23-year-old Fazliddin Zayniddinov from Tashkent.

Fazliddin Zayniddinov (prisoner): “It was September 2011, I was browsing the internet and via Skype talked with this man. This was Muhammadsolikh Abutov. This bad person asked me if I was from Uzbekistan. I replied that I was originally from Karakalpakistan. He told me that he was in jail and that he left for Sweden after his release. He told me that he has a peaceful and good life there. He even promised to help me to study abroad. In exchange, I had to circulate their leaflets containing their ideas. If I could, I should circulate them in the streets and places where people gather. I gave him my phone number. At about 8 PM he called me on my phone. He asked if I could come to the House of Culture [a concert hall]. He explained to me where the papers and money were hidden. I put the money into my pocket and gave away some of the leaflets on my way home. There were 100 US dollars”.

Now think for yourself. It took only 100 US dollars for this young man to commit a treason, in which he grew away his authoritative and honourable people and ruined his bright future. Although he is not an underdeveloped child in any capacity, neither is he a person who does not understand the consequences of his actions. The worst thing is that before distributing the leaflets he already was familiar with the content of the leaflets.

To start with, the leaflets were addressed to the popular movement of Uzbekistan on the day of commemoration of the Constitution. It said that in countries such as Egypt, Libya, and other Arab countries, there were popular uprisings and it was a call to carry out such an uprising in Uzbekistan.

This may be a right time to take a step back and tell the viewers that “so skilfully depicted so-called "Arab Spring" led to a revolution in the spirit and to a great tragedy.

Kobilbek Karimbekov, a political observer: Why were there so many strong social explosions? Because, if you pay a close attention, these regions are very rich in oil, gas, gold, uranium and other raw material, be it North Africa, Middle or Far East. Of course, in these heavenly spots or regions, many states seek their stake and want to turn them into their strategic interests. Naturally, historically military presence and strong holds of Western countries are located in the Arab lands. So, all the problems, difficulties, turmoil in the Arab world, the instability of the political system, the inability of states to rule played into the hands of some states. Because they use different ways to import weapon into the region, can make up the "opposition", can come up with different feigned ideological opponents.

Where did the opposition in the Arab countries come from? Where did the opposition get the modern military equipment? Naturally, if we can find answers to these questions, we can see greater active political powers surrounding these events. To say it more accurately, these are the political powers established their geopolitical interests. The ultimate goal of these powers is not to establish peace in those countries, imprudent of quality of life. If this was their goal, at least 3-4 Arab countries would already be on their way to peaceful development, increased productivity and capital turnover.

Let us look at the data for the last year and half: production of goods declined, influence from abroad has increased. In carrying out bloodshed of this kind, unfortunately, misinformation, which leads to massacres, has a large role to play. There is a reason why we call the information service “Akhborot” (Uzbek for New) a determining factor in our lives.  The news broadcasted in this programme excites our minds and awakens in us the awareness of duty to the Fatherland

«When their plan with Fazliddin Zayniddinov did not work out, the group of people rejected by the Fatherland decided to work with Surat Ikramov, who presents himself as a human rights activist. They try to hide their failure and spread rumours that the  human rights organisations came up with this intriguing plan”.

Fazliddin Zayniddinov (prisoner): “I am very sorry that I did not know what their true thinking was. I was not aware of their actual plans. I was blinded. I ask for pardon of the President and the nation for my mistakes. I did intend to carry out this kind of things”.

Saidkamol Abutov (prisoner, a bother of Muhammadsalikh Abutov): “I would like to say to the people who are in my brother’s entourage and listen to his calls: please protect yourselves and your family members from influence of his lies. Do not alienate yourself from the community. May God save you from being labelled as “anomies of the nation”. None of those who I knew have had a good live. If I am one of mislead, this is how I live. So do the others.”.

The moral of this story:

Jumaboy Matyakubov – he tried his best to enrol into a higher education institution, but he could not;
Saidkamol Abutov – a young girl lived with him only for 2 months, she could not take his despotism anymore and left him;

Jumaboy Matyakubov – he said that his father was not a Muslim but an infidel; 

Fazliddin Zayniddinov - I curse this man, thousands of curses;


Jumaboy Matyakubov – there is some kind of passion in the behaviour of this person, one can feel it;


Saidkamol Abutov - before listening to his high-flown speeches, one should look at his past life, at least for once;

            This is the true face of a man, characterised by demonstrative piety and political ambitions.

Abdumavlan Rakhimov (local community activist): For the last 20 years, thanks to the dedicated work of our nation, wise and fair policy of the President, we achieved very large and striking results, which are recognised by the entire world. We found our rightful place. We have created an amazing society, which is relevant and appropriate to ourselves. We have restored and reconstructed national statehood, our society and history are revived.

The 5 directions of development of our country designed by our leader completely paid off. We see evidence of this in the well-being of our society. Welfare of our nation rose very sharply. We can see this clearly when we travel through the regions of the country. On the streets one can see more cars than the roads can take. What does this tell us? This is a sign of a prosperous life. This is a sign of a fundamental change in the standards of living of the people. At the heart of the beautiful life and good living of the people is that people feel the fundamental idea of ​​national independence, love for their homeland, love the place where one grew up, became an adult, where his umbilical blood spilled, the love of the mother- earth and of the society. One puts a decent share of his endeavour into the development of society and the land where grew up and lives. This is the very real factor.

Unfortunately, there are some dark forces that cannot view the developing economic and political reforms of our state and its peaceful, quiet life in a normal way. These forces were not involved in any of processes which we carried out over the last 20 years. Most of the time, they flaunt religion and some other ideas and seek to come to power, as we have seen. It is not exaggeration to call them traitors. Since the betrayal of the motherland involves envy of all changes in the homeland, the destruction of peace and tranquillity, moral and social atmosphere in the homeland - in the heart of it all is a moral poverty. In the initial period of independence, we have chosen the way of development which is relevant and appropriate for us. The 5 directions of development designed by our esteemed president fully justified themselves. And no one can push us from this path. And I think that we give an appropriate, necessary, resistance to all these forces.

VATANGADO (Rejected by the Motherland)
Uzbek state, the Uzbek people are like a caravan pushing forward quickly and steadily. This is the way leading to a bright future. Now tell me, who can push us off this path? What force is able to bring us back from this radiant, shining path to a narrow, dark and terrible medieval ways? No One! All the aspirations and goals aimed at doing so are in vain.

Decent people cannot miss constructive, creative, flourishing businesses carried out  in this country and they will want to do their part. Instead of being at the forefront of such good deeds, some people follow the wanderers who are not distinguished neither in science and education, nor in religion or in humanity, nor in moral or ethical terms. They cannot be an example and are not able to do even the smallest of good deeds. They wished to renounce their Motherland and its people, they betrayed her.

Kyrgyz citizen Dilmurat Khaydarov did not go to Syria

In the village of Nariman, in southern Kyrgyzstan, in the house of the former political prisoner Dilmurat Khaydarov the police conducted a search.

Dilmurat Abdurasulovich Khaydarov was born on 8 June 1973; he is an ethnic Uzbek, a native of the village of Nariman, of the Kara-Suv district of Osh region of the former Kyrgyz SSR. He is married and has four children. He is a lawyer, does not have previous convictions.

From 27 June 2010 to 4 April 2014 he was in custody on charges of "organising mass riots". He was released under an act of amnesty. He is under international protection in accordance with the UN Convention on Refugees.

On 29 January 2015, at 7 o'clock PM, in the village of Nariman, where a former Kyrgyz political prisoner Dilmurat Khaydarov is registered, the search began, it lasted for five hours.

About 90 masked and armed Special Forces operatives ensured security of working operatives. During the whole operation, all the surrounding streets were blocked. The traffic was paralysed for a few hours. Residents of the Mumin Polvan Street could not access their homes, no explanation was given. Even the members of the local-governing body ensuring order did not get any clarification about the situation.

In the summer of 2014, Dilmurat Khaydarov and his family left Kyrgyzstan, and his sister looks after his house. She was taken from her place of work by an agent of the State Service for National Security (ГСНБ) who presented a warrant to search the house owned by Khaydarov. They said that they have "information about his participation in jihad in Syria" and have to search for weapons in his house.

Closer to 23:00 hours, Special Forces operatives began to disperse, they apologised to Dilmurat Khaydarov’s sister for the inconvenience. The whole house was ransacked, they even used mine detectors. There were no weapons found.
  • According to materials of the criminal case № 141-10-240 against the citizens of Kyrgyzstan Dilmurat Khaydarov, born in 1973; Khayrullo Saipov born in 1976.; Daniyar Kadyrov, born in 1970; Gani Sadikzhanov, born in 1974; Shukrullo Kochkarov, born in 1979; Bakhodir Sobirov, born in 1976. 

Dilmurat Khaydarov was arrested on 27 June 2010 during the "a clean up operation" conducted by the military in the village of Nariman. The authorities instigated two criminal cases against him on charges of the murder of Azhimamat Seyitov, a tax inspector at the village of Nariman and killing of two soldiers. He was charged under Articles 233, Parts 1, 2, 3, (organisation of, participation in the riots, calling for / inciting to disobey the authorities); 30-97, Part 2, paragraphs 4, 5, 9, 15, (complicity in the murder); 30-174, Part 2, paragraph 2 (complicity in the destruction of property); 28-340 (attempted murder of a law enforcement officer and a soldier) of the Criminal Code of the Kyrgyz Republic.

During the investigation of the criminal case the fact of murder of Seyitov was not established, as his body was never found. But Khaydarov was charged under Article 30-97 of the Criminal Code (complicity in murder). This charge carries a prison sentence of up to life imprisonment.

The trial lasted for four years.

On 4 April 2014 Dilmurat Khaydarov was released under an amnesty, as evidenced by the certificate of release. On the basis of the appeal by the victims and the prosecutor, the case was reopened, and Dilmurat Khaydarov was declared wanted.
  • Chronology of events

     – 7 October 2010: the Karasuy District Court (the Judge P.A. Baysunov) handed down its Decision on the criminal case of Saipov’s murder redirecting the case for additional investigation;
     – 2 November 2010: the Osh Regional Court upheld the Decision of the Karasuy District Court;
     – having considered the complaint by the victims to the Supervisory Court regarding annulment of the decisions by the Karasuy and Osh Courts, the Supreme Court upheld the decisions of the Court of First and the Second Instances;
     – 11 February 2011: the Karasuy District Court (the Judge M. Dzhalalova) handed down its Decision redirecting the case for additional investigation;
     – 28 September 2011: at the Karasuy District Court, the Judge M. Dzhalalova refused to consider the criminal case, because, during the hearing, the victims attacked the defendant D. Khaydarov;
     – 4 November 2011: during the hearing at the Karasuy District Court, the defendants challenged the Judge Z. Apyshev;
     – 20 January 2011: the Karasuy Distric Court (the Judge N. Matraimov) handed down its Decision on the criminal case regarding murder of two soldiers and sentenced D. Khaydarov to 8 years of imprisonment;
     – 2 March 2011: the Osh Regional Court overruled the Decision of the Karasuy District Court dated 20 January 2011;
     – 26 May 2011: the Supreme Court upheld the Decision of the Osh Regional Court and returned the case for reconsideration;
     – 22 July 2011: the Karasuy District Court (the Judge M. Dzhalalova) decided to send the case for additional investigation;
In November 2011 the two criminal cases against D. Khaydarov were joined;
     – 22 February 2012 the Karasuy District Court (the Judge S. Zakirov) issued its Decision to resend the case for additional investigation.
Following this Decision, the victims sent their apposing application asking the Osh Regional Criminal Court to continue the trial.
     – 12 April 2012: at the hearing of the Osh Regional Court (chaird by the Junge М.М. Toktamishev, and panel of the Judges И.М. Ashirbaeva, К.М.Turgumbayev) the Decision handed down by the Judge S. Zakirov was quashed, the case was returned to the Karasuy District Court. The case was heard by a different judge.
     – In the following 10 days, the lawyer representing the defendants appealed this decision to the Supreme Court of Kyrgyzstan insisting that the Decision by the Judge S. Zakirov of the Karasuy District Court has to be upheld.
     – 2 August 2012: the Supreme Court of Kyrgyzstan upheld the Sentence of the Osh Regional Criminal Court dated 12 April 2012.
      – 25 January 2013: the Osh City Court headed by the Judge B.A. Osmanov started hearing of the criminal case № 141-10-240 After few court hearings, the victims challenged the Judge and the case was transferred to the Judge R.B. Kozhomkulov who considered the case for about a year.
      – 22 January 2014: the Judge Ramazan Burkanovich Kozhankulov of the Osh City Criminal Court sentenced D. Khaydarov to 7 years of imprisonment on the basis of Article 233, Part 2 (participation in mass riots).
    – 26 March 2014: the Decision of the Osh Regional Criminal Court (chaired by the Judge A.E. Kurbanov and panel of Judges A.Dz. Abdillaev and M.M. Toktamushev) was handed down. It sentenced Dilmurat Khaydarov, in accordance with Article 233, Part 1 (organising the mass riots), to 10 years of imprisonment. Previously, he was accused of part 2 of the same Article (participation in the mass riots) (punishable with imprisonment of up to 8 years). Other defendants  in the case were sentenced as follows: Part 2 of Article 233: Sh. S. Kuchkarov, B.Zh. Sobirov, D.N. Kadyrov– to 6 year of imprisonment, Kh. A. Saipov and G.E. Sobirzhanov – to 8 years of imprisonment. The charges of under Articles 97 (murder), 340 (encroachment on the life of an officer of a law-enforcement agency), 172 и 174 against the defendants were dropped. The Court was not offered any evidence of the accusations. The only «evidence» of the guilt of the defendants was their leadership skills. According to acts of amnesty issued in 2011 and 2014 the defendants were released.
     – 4 April 2014: at the Pre-Trial Detention Centre (СИЗО) they were issued certificates of their release confirming that they served the term under the Sentence dated 26 March 2014.
     – Not long after that, the victims appealed to the Cassation Court against the Sentence of the Osh Regional Criminal Court.
     – 24 June 2014: the Supreme Court of Kyrgyzstan heared the case and returned the case to the Karasuy District Criminal Court. However, the case was heard by the Osh City Court because the victims challenged the Judges of the Karasuy District Court.
    – 25 July 2014: the Osh City Criminal Court reconsidered the Sentence handed down on 26 March 2014 and decided to reopen the trial of the criminal case.
